GWWD - Terms of Service - Website Development
The cost of your Website is determined by the package you have chosen from our list of products, services or a custom designed proposal.
- Original initial design concept (layout, graphics, navigation structure) of the Website, a picture in JPEG, PDF or PNG format
- Custom graphics & website colour scheme developed exclusively for you (except for the logo & site images)
- Uploading of your Website to the hosting server of your choice (either GWWD Servers or a 3rd Party Vendor)
We offer two types of development turnaround time: Normal and Urgent.
In the Normal mode, the initial design concept is developed and sent to you, the Customer, in 10 to 14 working business days. This is the amount of time required to thoroughly research your business and understand all its details before we create your unique design. We may contact you by e-mail for additional details and discussion.
In the Urgent mode (+30% "rush" charge applied) you'll receive the initial design concept in 5 working days.
The time for creation of your initial design concept - plus additional time needed for implementation of your approved design into HTML (cut up the concept, insert your images and text) - will make up the total time to complete your project (up to 20 working weekdays).
In case you have a database driven Ecommerce Website the total time for completion of your project is 20 to 30 working weekdays. The exact period can be found in the specification for your project.
The number of alterations you desire - plus additional time needed for implementation of your approved design - will make up the total time to complete your project. Each alteration usually requires up to 48 hours in the Normal case - and up to 24 hours in Urgent cases - after we receive your input to our project inquiries.
Communication and Delivery:
All communication about, and delivery of, completed work will be conducted by e-mail. You agree to confirm receipt of all e-mails from us by sending our company a "receipt" e-mail. This ensures that there is a virtual "paper trail" documenting our communications throughout the process. The completed work will be delivered to you via e-mail.
We accept payments by:
- Direct Debit Facilities
- PayPal & Credit Card (PayPal Transaction Fees may apply)
- Cheque or Money Order.
Ongoing hosting service payments are collected through Paypal subscription only to ensure regular, on time payments are made by clients to the hosting company and that your website and emails remain active and online.
The Website Development Process:
We require a 75% pre-payment of service total upfront to start the design of the initial design or marketing concept.
Development of your Website begins only when the pre-payment is received. Once you approve the Concept and pay remaining amounts, we'll do HTML realization and send you the final package or upload the complete Website to your hosting server.
The remaining 25% of the service total, is payable once design and layout has been approved by the client or the project has been completed under the Website Proposal documentation provided to the client by GWWD. The website will not be published online until final payment has been received and failure to pay will result in penalty fees being charged.
In some cases we retain the right to issue an additional quote after receiving payment for a logo; i.e. when you request other custom features which are not part of the stated project plan. You'll be advised if this is relevant to your project, and then have the option of accepting or rejecting this additional expense.
In no event GWWD will be liable for suitability, merchantability, protection, loss of data/income or usability of products and services developed and delivered.
All care and precautions are taken by GWWD with a Client's Website, Hosting and Email Security, however, in the event that a website or emails are lost, damaged or deleted due to malicious damage, hacker or virus attack or server failure/malfunction, GWWD is not responsible for the Client's data, files, design, images, information or any other content that is being hosted by GWWD.
Repair or replacement of such items, is at the cost of the Client and GWWD cannot and will not be held responsible for any loss of income or damages, such an event may cause to the client.
It is the responsibility of the client to choose where there website and emails are hosted and they are free to move these services to another vendor at anytime, provided they have given GWWD 7 days, written notice.
Final products developed by GWWD are the sole property of the Customer once payment has been made in full. However, the initial concepts remain our property. We have the right to place products developed on the portfolio page of our Website.
Termination and "On Hold" Policies:
You can ask us to put a design "on hold" at any time, then resume its development within two months of your payment. If the client halts work or applies by registered letter for a refund, 50% will be deducted from the initial payment, the balance of which shall be returned to the client in 3 business days after receiving the letter.
GWWD has the right to Terminate a Client's Account or Ongoing Services, at anytime, immediately once written notice has been given to the Client.
Reasons for Termination could and may include the following - Failure to pay for services rendered, Abusive or Threats by the Client, Offensive Products or Services sold or listed by the Client, Ongoing support demanded by the Client without making payment, and any other reason GWWD deems to be worthy of Termination of Products or Services.
Website/Email Hosting Security & Backup:
GWWD does offer it's Website & Email Hosting Client's a Security and Daily Backup Services, however GWWD do not have have any liability for any Data that might be lost, corrupted or is unrecoverable whether or not you buy a Security/Data back-up plan from us or by reason of your failure to back up your own Data.
To keep your website safe from attack both during and after your website is created, GWWD provides Website Security and Daily Backup services automatically included in every GWWD website/email hosting service.
This is to designed to maintain your hosting security and inturn deterring hackers, viruses and malware infections from corrupting your website, emails, cpanel, data that is being hosted on a GWWD Server.
But it is a deterrant ONLY and not fail safe/error free protection for your Cpanel, Website and Email Hosting. If your Data is important to you or your business, then we suggest that you also take out an insurance policy against any loss or damage suffered or incurred by you for any Data loss or corruption.
If you are not a Website / Email Hosting Client of GWWD, then it is your sole responsibility to keep your Data and Emails secure and backed up on a daily basis. Failure to do so and any data lost is not the responsibility of GWWD.
These Terms of Service are the complete Agreement between GWWD (Great White Web Design) and the Customer. This Agreement supersedes all prior agreements or promises made by GWWD's representatives that differ in any way from these Terms and Conditions.
Any modifications of this Agreement must be in writing signed by the party or parties to be bound by modifications.
Any notices required under this Agreement must be delivered in person, mailed (properly addressed and with postage prepaid), faxed or e-mailed to the party entitled to receive the notice.
The Customer agrees that it shall defend, indemnify, save and hold GWWD harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against GWWD, its agents, Customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by the Customer, its agents, employees or assigns.
The Customer agrees to defend, indemnify and hold harmless GWWD against liabilities arising out of:
(1) any injury to person or property caused by any products sold or otherwise distributed in connection with GWWD;
(2) any material supplied by Customer infringing or allegedly infringing on the proprietary rights of a third party and
(3) copyright infringement.
